Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services provided by Politimate LLC ("Politimate," "we," "us," or "our"), including the Canvass by Politimate product available at canvass.politimate.com (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
2. Acceptable use
You agree to use the Services only for lawful purposes and in compliance with all applicable laws, including election, campaign finance, privacy, and communications laws in your jurisdiction. You agree not to misuse the Services, interfere with their operation, attempt to access them by unauthorized means, or use them to store or transmit unlawful, infringing, or harmful content.
3. Your data
You retain ownership of the data you upload to the Services, including voter and volunteer information ("Your Data"). You grant us a limited license to host, process, and use Your Data solely to provide and improve the Services. You are responsible for ensuring you have the legal right to collect and use Your Data and that your use complies with applicable law.
4. Subscriptions and payment
Paid plans are billed in advance on a recurring basis (for example, monthly) through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method for the applicable fees until you cancel. Fees are stated on our pricing page and may change with notice. Except as described in our Refund Policy, payments are non-refundable.
5. Cancellation
You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of your current billing period, and you will retain access until then.
6. Intellectual property
The Services, including all software, design, and content we provide, are owned by Politimate LLC and protected by intellectual property laws. These Terms do not grant you any right to our trademarks, logos, or other brand features.
7. Third-party services
The Services may integrate with or link to third-party services (such as payment processing and voter data providers). We are not responsible for third-party services, and your use of them is governed by their own terms.
8. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, Politimate LLC and its members and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim.
10. Termination
We may suspend or terminate your access to the Services if you violate these Terms or if we reasonably believe your use poses a risk to us, other users, or third parties. Upon termination, your right to use the Services ends.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice, such as by posting the updated Terms and revising the date above. Your continued use of the Services after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the United States and the state in which Politimate LLC is organized, without regard to conflict-of-law principles.
